Staff Analysis of the Legislation

SB 326 amends Article 1 of Chapter 10 of Title 17 and Article 2 of Chapter 3 of Title 35 of the OCGA to define ‘nonviolent offense’ and ‘violent offense’. Convicted non-violent defendants whom have committed offenses as a result of being a victim of a trafficking offense may petition the trial court to vacate such conviction and, if vacated, for the court to issue an order vacating the conviction that restricts access to the criminal history record information regarding the offense.
